Services Provided
Whiz offers logistics and courier services including reliable pickups, deliveries, warehouse fulfilment and reverse logistics. We provide affordable pricing, access to remote destinations, text and email notifications, proof of delivery and transshipment hubs. Our real‑time tracking feature lets customers follow shipments via personalised links.
Accounts and Registration
Certain features require you to create an account (for example, merchant or driver portals). You agree to provide accurate, current and complete information and to maintain the confidentiality of your credentials. Notify us immediately of any unauthorised use.
Driver and Merchant Registration
Drivers must provide valid licences, vehicle and insurance details and consent to background checks. Merchants must ensure that shipments comply with applicable laws and are properly packaged and labelled.
User Responsibilities
- Comply with all laws and regulations governing shipping, customs and transportation.
- Provide accurate pickup and delivery information.
- Not ship prohibited items (hazardous materials, illegal goods or contraband).
- Respect our couriers and staff; abusive behaviour may result in termination.
- Consent to communications via phone, text or email for bookings, tracking updates and proof of delivery.
Payments and Fees
You agree to pay all fees for services you purchase. Prices vary based on distance, package size and service level. Payments are processed by third‑party providers, and drivers’ or merchants’ payouts may be subject to service commissions and taxes. Fees are generally non‑refundable unless required by law.
Cancellation and Refunds
Customers may cancel bookings up to a designated cutoff time. Fees may apply for late cancellations or failed pickups. If delivery is impossible due to circumstances beyond our control (for example, wrong address or unavailable recipient), we may return the package or hold it; extra charges may apply. Refund requests will be handled case by case.
Intellectual Property
All content on our website—text, graphics, logos, images, software and their arrangement—is owned by Whiz Delivery or its licensors and protected by copyright and trademark laws. You may not reproduce, modify, distribute or exploit any content without our prior written consent. You may use the site for personal or legitimate business purposes related to deliveries, provided you retain proprietary notices.
User Content
If you upload or transmit content (for example, cargo descriptions, instructions, feedback), you grant Whiz a non‑exclusive, worldwide, royalty‑free licence to use, adapt and display that content to provide the services. You must have the necessary rights to submit the content and agree not to post anything unlawful, defamatory, abusive, discriminatory or otherwise objectionable.
Prohibited Activities
- Damage or impair our website or interfere with others’ access.
- Attempt to hack, decompile or reverse engineer our software.
- Upload malware or harmful content.
- Collect personal data of other users without consent.
- Use our services for illegal purposes (money laundering, fraud, contraband shipment).
Service Availability and Performance
We strive for reliable pickups and deliveries but delivery times are estimates and not guaranteed. Factors such as weather, traffic or regulatory delays may affect deliveries. We may modify or suspend services at any time without liability.
Limitation of Liability
To the maximum extent permitted by law, Whiz Delivery shall not be liable for indirect, incidental or consequential damages, including lost profits or business opportunities. Our liability for loss, damage or delay of shipments is limited to the lesser of the actual value of the goods or the amount specified in our rate guides or insurance policies, unless you declare a higher value and pay the corresponding fees. We are not liable for delays caused by events beyond our control.
Indemnification
You agree to indemnify and hold harmless Whiz Delivery, its officers, employees and agents from any claims, damages, costs and expenses (including legal fees) arising from your violation of these Terms, your misuse of the services or your infringement of any rights of a third party.
Termination
We may suspend or terminate your access at any time if you violate these Terms or misuse the services. Upon termination, sections relating to intellectual property, indemnification, limitation of liability and other provisions that by their nature should survive will continue to apply.
Changes to Terms
We may revise these Terms from time to time. We will post updates on our website, and continued use after any changes constitutes acceptance of the revised Terms. If you do not agree to the changes, you must stop using the services.
Governing Law and Dispute Resolution
These Terms are governed by the laws of the Province of Ontario and the federal laws of Canada. Any disputes shall be resolved through arbitration or the courts of Ontario, unless consumer‑protection laws require another venue.
General Provisions
- Entire agreement: These Terms, together with any supplemental agreements and our Privacy Policy, represent the entire agreement between you and Whiz Delivery.
- Severability: If any provision is found invalid, the remainder will remain in effect.
- Waiver: A failure to enforce any right or provision does not constitute a waiver of that right.
